Without knowing more about what's going on, my first thought is that this would be transactional mail, and not subject to the unsubscription requirements. The unsubscription requirements only attach to commercial email. So, if the mail that is being sent isn't marketing anything, it's probably okay.

Do you know if I can send email to members who have unsubscribed, who's membership has expired, but for one reason or another still owe money? These emails would not be marketing emails, simply debt collection messages.

Great points and investigation, Mickey!
Now that the Act has been around for a while and they have seen more use cases, the FTC could definately use some further clarification on CAN-SPAM. Especially with the rise of transactional messaging over the past two years.
