So, Colorado has passed a new anti-spam bill. If their governor signs it, we Could See a Crackdown on Spam (says the email from Google Alerts). Or will we?
What this bill does is replace Colorado’s existing anti-spam law with a new one that makes it a state criminal offense to violate the federal CAN-SPAM Act.
Since CAN-SPAM was passed there have been a several enforcement cases (I haven’t found a good, recent cite on the exact number). But, the vast majority of cases brought involving spam are prosecuted (and eventually resolved) on other grounds. Mainly this is because the FTC is overworked and understaffed.
But, now it appears the Colorado’s legislature thinks that local prosecutors should lend a hand. The question is, who are they going to go after. Boulder, Colorado Springs, and Denver are not hotbeds of spammer activity. Unlike, say, Boca Raton, Florida.
And some reporter thinks that this is going to help?
I could only wish.
