MySpace sues TheGlobe.com for CAN-SPAM violations

TECHNOLOGY: MySpace sues for e-mail

News Corp.’s MySpace.com, a social networking Web site, sued TheGlobe.com Inc. for $62.3 million, claiming that the rival site operator sent more than 100,000 unsolicited e-mail messages to MySpace users.

The e-mails, advertising telephone software, appeared to have been sent by real MySpace users and displayed the MySpace trademark without authorization, the company said in a lawsuit filed Thursday in federal court in Los Angeles. The complaint alleges violations of the U.S. Can-Spam Act, as well as trademark infringement and breach of contract.

“Attempting to capitalize on the popularity of MySpace.com, TheGlobe.com implemented a scheme to falsely gain access to the MySpace Web site for the purpose of spamming MySpace users,” Santa Monica, Calif.-based MySpace said.
