Florida Sues Spammer Touting Bogus Fuel Saver

Now you might think that this is just another spammer getting sued for selling fraudulent products. But, you would be wrong. This isn’t just another spammer getting sued because he is selling the wrong thing. No, this suit is against the spammer for spamming.

The Federal Trade Commission launched Federal Trade Commission, Plaintiff, v. International Research and Development Corporation of Nevada, et al. in November of 2004. So far, they have settled with Net Marketing Group, LLC, Diverse Marketing Group, Inc., Diverse Marketing Group, LLC, Floyd J. Tassin, Jr., Marcia Tassin, and Mark C. Ayoub. It was during the course of discovery for the case that several spammers were uncovered.

This lawsuit is against one of those spammers. According to the Florida Attorney General’s office, Rodriguez “sent or assisted the sending of more than 1,100 illegal emails to over 2,500 recipients.” I’m guessing this means that he sent 2,500 people 1,100 messages each (as opposed to sending just over half a message to 2,500 people).

This suit is a rarity, but I think it’s also a harbinger of where things are going. It’s a suit that follows the money trail to the spammer instead of trying to find the spammer solely from the headers. Even though the spammer wasn’t actually the one selling anything, he was getting paid to advertise illegally. I think we’re going to find more and more of these lawsuits coming in the future.
